Announcement on the protection of personal information of service users of the Elderly Care Center
JAS Asset Public Company Limited (“the Company”) has the purpose of informing this Personal Data Protection Notice (“Notice”), which sets out about the processing of the personal information of the Inquiries for use, serve and/or service users of the elderly care center (“Service User”), in order for the service user to be informed, when the user agrees to provide personal information to the Company to get in touch and receive services in any manner and procedure, the Company will assume the user agrees and accepts this notice.
If the service user does not agree to the Company to process your personal data as stated under this announcement, the Company reserves the right to refuse contact or providing services to such users. As the processing of personal data under this notice is very necessary for the performance of duties performed by the Company to the users, the Company may update this notice from time to time to comply with relevant practices and laws and in accordance with the service business operations and processing of personal data by the Company. The Company will notify the user of the changes by posting the updated announcement through the Company’s contact channels.
The Company may obtain personal information of the personal data subject directly from the service user through various channels, including inquiries through various channels that the Company may have for contacting users with users; or the service users fill out and provide information including documents for registration, including in the form of using other support services for applying for the Senera Elderly Care Center or other services, and the Company may obtain from external service providers that the Company may employ to collection information, partners, including affiliates, the Company will notify users of the source of information.
General information and contact information
including name-surname, address, e-mail, telephone number, social media (such as Line ID), including a copy of ID card and/or a copy of the house registration
Information and documents supporting the application form
including the personal data contained in the service application form and a photograph attached in the application form
Health information of service users
including congenital disease information and preliminary health information from pre-service assessment to service users
Payment information
including payment information and related expenses for using the service, such as proof of payment, bank account, credit card
Other people’s personal information, including relatives or emergency contacts
including personal information of relatives or emergency contact person, including name, surname, contact information, copy of ID card or house registration of such person. The user guarantees the accuracy of personal information and the user’s right to disclose and forward such person’s personal data to the Company for processing under the terms of this notice
Other personal information
including but not limited to Other information that users may provide to the Company for participation in prize draws or other promotional activities (This may include photographs from participating in such activities) or any other information that the User may provide to the Company in any other service form, including the communication information that the Company may have with the service users
The Company will collect, use, process and store personal information of the service users for legitimate purposes without causing unreasonable impact on the fundamental rights in the personal data of the service users as the personal data subject, the Company will process all the personal data specified for the following purposes:
- For the evaluation of qualifications and pre-service assessment including the performance of duties and rights under the service agreement of the elderly care center including but not limited to (i) the service of contacting back to users who have expressed interest in using the service (ii) consideration of the assessment of the eligibility and suitability of providing services to users. However, if it is a sensitive personal data such as health data, the Company will request consent from the service user before processing such personal data (iii) coordinating and providing services to service users whether it is a direct contact with the service user or coordination with relatives or emergency contacts provided by the service user; and (iv) performance of other contracts to which the user and the Company are parties or to be used to process requests from users including but not limited to service within the care center, checking and following up on the collection of administrative payments or other expenses including providing other support services as users may request support from the Company
- For the performance of legal duties that the Company may have to comply with which may include but not limited to duties under the Accounting and Tax Documentation Act including any other statutory duties
- For the legitimate interests of the Company or of another person without prejudice to the legitimate rights of the data subject excessively which including but not limited to (i) building and improving the business relationship the Company has with its users. This may include analyzing, investigating, managing and resolving issues related to the provision of the Company’s services, service satisfaction inquiry (ii) service interest analysis in order to improve the services provided by the Company to meet the needs and interests of the user (iii) protect and defend any claims the Company may have against its users throughout the relevant period as stipulated by law (iv) use of photographs and other public relations information of users participating in various marketing activities for the benefit of the Company’s public relations materials
- In the event that the service user gives consent The Company will process the user’s personal data for the specific purposes for which the user has given specific consent, such as using the information for the Company’s public relations or direct marketing purposes or of affiliated companies or forwarding and disclosing personal information of service users to affiliated companies and/or partners for marketing by affiliates or partners, etc. The user has the right to withdraw the user’s consent given to the Company at any time
The Company will collect personal information of all users as long as it is necessary, taking into account the purpose and the need for the Company to collect and process. This includes complying with the requirements of applicable law in such matters throughout the term of the relevant service contract, and for the purposes of safeguarding legitimate interests, the Company may process personal data for a period of time that is necessary for business purposes, ensuring that the user’s rights are not affected unnecessarily and in the case of processing with the consent of the user, the Company will process the data until the user withdraws their consent.
In principle, the personal information of the service user received by the Company will be kept confidential, but the Company may need to disclose and forward such personal information to
- Disclosure to the Company’s external service providers This may include (i) affiliates, partner company, third-party service providers that provide support services to the Company in providing services or performing duties and exercising rights that the Company may have towards service users such as personnel support service providers, Information Technology service provider (ii) Service providers involved in the Company’s business operations including but not limited to consulting service provider to the Company, the Company will forward and disclose personal information of the service user only within the specified objective margin on a sparing basis, under the framework of the Personal Data Processing Agreement to be drawn up
- Relevant government agencies which the Company has legal duties or subject to judgment or an order of a government agency to disclose personal information of personal service users to such agencies whereby the Company shall disclose and transmit information only as necessary in accordance with the said duties; and
- Other agencies in which the service user has given their express consent to the Company to disclose personal information of the user to such person
In the event that the Company transfer and/or sends personal data to foreign countries, the Company will set standards for entering into agreements and/or contracts with business entities, the organization to which the personal data will be obtained have accepted standards for personal data protection and in accordance with the relevant laws, to ensure that personal information will be protected safely.
The Company guarantees that appropriate security measures are in place to prevent any unauthorized or abusive access, use, change or modify disclosure of personal information that the Company receives. The Company will provide periodic reviews of such measures to ensure their suitability with industry standards and in accordance with relevant law
The Company respects the legal rights of users, as a personal data subject in relation to your personal data that is in the Company’s control, you can request to exercise the rights you have in accordance with the conditions set forth in the law as follows: (1) Right to request for access and obtain a copy of personal data including the right to request correction of personal data to be correct (2)Right to request personal information in the event that the Company makes personal data in a form that can be read or commonly used by means of automated tools or equipment including the right to request the transmission or transfer of such form of data to another personal data controller (3) Right to object to the processing of personal data (4) Right to request to removal or destruction or to make personal data non-personally identifiable when that information is no longer needed (5) Right to request the suspension of the use of personal data; or (6) Right to withdraw consent, in order to process the information that the data subject has previously provided for the purposes stated.
