Notice of the Personal Data Protection for Students of Senera child and elderly care school
JAL Assets (Public Company) Limited (“the Company”) has the purpose of informing this Personal Data Protection Notice (“Notice”), which sets out about the processing of personal data of contact persons to request the information related to the study and/or applicants for admission to the Program (“Course”) and the student in Senera child and elderly care school (“Student”) to be aware of. When the student agrees to provide personal information to the Company to be in contacted and attend courses, regardless of the nature and procedure, the Company will assume that the student agree and accept this announcement.
If the student do not agree to the Company to process your personal data as stated under this announcement, the Company reserves the right to refuse contacting or providing services to such student. Since the processing of personal data under this notice is absolutely necessary for the performance of the Company’s duties to the student. The Company may update this announcement according to appropriate time to comply with relevant practices and laws and in accordance with the service business operations and processing of various personal data by the Company. The Company will notify the student of the changes by publishing the revised notice through the Company’s contact channels.
The Company may obtain personal information of the personal data subject directly from the student through various channels, including contacting inquiries or through contact channels, including contacting inquiries through the channels that the Company may have for contacting student; or when student fill out and provide information including documents for enrollment in the course, including the form of using other supporting documents for the application to study in the course or other services and the Company may obtain from external service providers that the Company may employ to collect information, partners, including affiliates. The Company will inform student of the source of information.
General information and contact information
including name-surname, address, e-mail address, telephone number, social media (eg Line ID), including a copy of ID card and/or a copy of the house registration
Information and supporting documents for the application form of the course
including the personal data contained in the application form, attached photographs in the application form, including information on academic qualifications, work or other eligibility information for admission to a given course
Payment information
including information on payment fees for applying to study in the course or other services such as proof of payment, bank account, credit card
Sensitive personal data
including recorded fingerprint data of student who need to access to the area and recording hours of attendance or course-based internships and health or disability information of student that affect the eligibility and suitability for entry according to the conditions set forth in the course conditions
Other personal information
including but not limited to other information that student may provide to the Company for participationin prize draws or other promotional activities (This may include photographs from participating in such activities) or any other information the student may provide to the Company on any other service form including any communicative information that the Company may have with student
Other people’s personal information, including relatives or emergency contacts
including personal information of relatives or emergency contact person, such as name, surname, contact information of such person. In the event that the student provide the information of such other person to the Company, the Company shall be deemed that the student guarantee the accuracy of personal information and the student’s right to disclose and forward such person’s personal data to the Company for processing under the terms of this notice
The Company will collect, use, process and maintain personal information of student for legitimate purposes without impairing the fundamental rights of the student’s personal data as the subject of personal data unreasonably. The Company will process all the personal data specified for the following purposes:
- for qualification evaluation and assessment of student’s suirtability according to the conditions of the curriculum including the performance of duties and rights according to the conditions of course service This includes but not limited to (i) providing contact services to student who have expressed interest in the course, (ii) reviewing assessments of eligibility and suitability for attendances and interships including evaluating the achievement of admission under the course conditions for student. However, if it is sensitive personal information such as health information or fingerprint information of student, the Company will obtain consent from the student before processing such personal data (iii) coordinating and providing services to student whether it is liaison with student directly or coordination with relatives or emergency contacts provided by the student; and (iv) compliance with other contracts that the student and the Company are counterparties to or to be used to process student requests including but not limited to teaching services according to the curriculum, checking and following up on the collection of administrative payments or other expenses including other supporting services as student may request for support from the Company.
- for the performance of legal duties that the Company may have to comply with This may including but not limited to Duties under the Accounting and Tax Documentation Act including any other statutory duties. This may include submitting all Company records or student details to regulators.
- for the legitimate interests of the Company or of another person without prejudice to the legitimate rights of the data subject excessively including but not limited to (i) building and improving the business relationship that the Company has with its student. This may include analyzing, investigating, managing and resolving issues related to Company course, inquiring about the satisfaction of attending the course (ii) analyzing the student’s interest to improve the style of the Company’s curriculum to be able to meet the needs and interests of the student more (iii) protecting and defending any claims the Company may have against the student throughout the relevant statute of limitation as stipulated by law (iv) using of the photographs and other publicity information of student who attend or participate in various marketing activities for the benefit of the Company’s public relations materials
- In the event that the student gives consent The Company will process the student’s personal data for the specific purposes for which the students has given specific consent, such as using the information for the Company’s public relations or direct marketing purposes or of affiliated companies or partners, etc. The student has the right to withdraw the student’s consent to the Company at any time.
The Company will store all personal information of the student as long as it is necessary, taking into account the purpose and the need for the Company to collect and process. This includes complying with the requirements of applicable law in such matters throughout the contract period of service according to relevant courses and for the purposes of safeguarding our legitimate interests. The Company may process personal data for a period of time that is necessary for business purposes, ensuring that the student’s rights are not affected unnecessarily and in the case of processing with the consent of the student, the Company will process the data until with student withdraws the consent.
In principle, the personal information of the student obtained by the Company will not be disclosed to third parties. But the Company may need to disclose and transmit such personal information to the following persons
- Disclosure to the Company’s external service providers This may include (i) affiliates, partner company, third-party service providers that provide support services to the Company or performing duties and exercising rights that the Company may have on the student, such as personnel support service providers (such as lecturers), Information Technology system providers (ii) Service providers involved in the Company’s business operations including but not limited to Consulting service provider to the Company. In this regards, the Company will forward and disclose personal information of the student. (iii) moreover, it may also include forwarding and disclosing student information to the training centers or elderly care centers or other partner service providers that provides training support and curriculum management to the students only in accordance with the stated objective margin on a sparing basis; under the framework of the Personal Data Processing Agreement to be drawn up
- Relevant government agencies which the Company has legal duties or subject to judgment or an order of government agencies, including but not limited to The Revenue Department or other regulatory agencies of the Company, which the Company must disclose personal student’s personal information to such agencies, whereby the Company shall disclose and transmit information only as necessary in accordance with the said duties; and
- Other agencies in which the student has given the express consent to the Company to disclose personal information of the student to such person
In the event that the Company transfers, copies and/or sends personal data to foreign countries, the Company will set the standards for entering into agreements and/or business contracts with agencies, organizations to which the personal data will be obtained have accepted standards for personal data protection and in accordance with the relevant laws, in order to ensure that personal information will be protected safely.
The Company guarantees that appropriate security measures are in place to prevent any unauthorized or abusive access, use, change or modify disclosure of personal information that the Company receives. The Company will provide periodic reviews of such measures to ensure their suitability with industry strandards and in accordance with relevant laws.
The Company respects the legal rights of students as a personal data subject in relation to your personal data that is in the Company’s control which you can request to exercise the rights you have in accordance with the conditions set forth in the law, namely; (1) Right to request for access and obtain a copy of personal data (2) Right to request correction of personal data (3) Right to obtain and forward personal data that has been stored in a readable or generally usable format with tools and equipment that can work automatically (4) Right to object to the processing of personal data (5) Right to request the removal or destruction or to make the personal data non-personally identifiable when that information is no longer needed (6) Right to request the suspension of the use of personal data (7) Right to withdraw consent and (8) Right to make a complaint.
