JAS Asset Public Company Limited (“the Company”) has the purpose of informing this privacy policy which defines the processing of personal data of customers (“Customers”) who contact the Company through various channels and/or agree to enter into consignment transactions, rental deposit, including using other services (including but not limited to providing maintenance, refurbishment and cleaning services (“Services”) for the customers to acknowledge, when the customer agrees to provide personal information to the Company to receive contact and services, regardless of the nature and procedure the Company will assume that the Customers agrees and accepts this privacy policy.
If the customer does not agree to the Company to process your personal data as stated under this Privacy Policy, the Company reserves the right to refuse contact to the customer or services, because the processing of personal data under this policy is essential to the performance of the Company’s obligations to customers. The Company may update this policy from time to time to comply with applicable practices and laws, and in accordance with the service business operation. The Company will notify customers of any changes by posting the revised policy through the Company’s contact channels.
The Company may obtain the personal information subject directly from the customer through various channels, including contacting inquiries through various channels that the Company may have for contacting customers; the customer’s participation in the Company’s promotional activities through various channels or the customer filling out, submitting information, including other documents to support consignment or lease documents and contract or a lease agreement to be signed with other customers interested in leasing or buying or other services, and the Company may obtain from external service providers that the Company may employ to collect information, partners, including affiliates. The Company will notify the customer of the source of the information.
General information and contact information
Including name-surname, address, e-mail, telephone number, Social Media (such as Line ID), including copy of ID card
Property related information and documents
Including copy of the land title deed including photos of properties offered for purchase-sale or rent
Service usage information and payment of related services
Including real estate information that customers are interested in buying-selling or renting including service request information as well as any other information the customer may provide companies in various forms and may include payment information (which may include proof of payment)
Website usage information
Including the IP address of the computer, the type of browser, the device settings used to access the website, website usage behavior data
Communication information
Including conversation information through various channels of the Company’s service before using the service, the service coordination
Contract related information
Including name-surname, ID number, address, and other necessary information for preparation and document the contract between the customer and the Company, and between the customers who want to consignment and customers who want to buy, and between tenants including the performance of duties by customers for the Company (including but not limited to payment of services to the Company)
Other personal information
Including but not limited to other information the customer may provide to the Company for participation in prize draws or other promotional activities (This may include a photograph of the data subject) or any other information that the customer may provide to the Company in any other form of use of the service
The Company will collect, use, process and maintain personal data of the data subject for legitimate purposes without impairing the fundamental rights of personal data subjects of the personal data subject unreasonably. The Company will process all the personal data specified for the following purposes:
- For the performance of duties and rights under the contract that the Company may have with its customers under the consignment/lease agreement, the service contract is signed and executed between the Company and the customer including but not limited to (i) the service of contacting back to users who have expressed interest in using the service (ii) consideration and verification of the rights of customers who wish to consignment or lease deposit (iii) service and coordination for arranging contracts between customers who consign or lease deposit with customers who have to buy or rent, including coordination for service (including but not limited to the provision of renovation, refurbishment, cleaning services, etc.) (iv) performance of other contracts to which the customer and the Company are the parties or for use in the processing of customer requests
- For the performance of legal duties that the Company may have to comply with which may include but not limited to duties under the Accounting and Tax Documentation Act including any other statutory duties
- For the legitimate interests of the Company or of another person without prejudice to the legitimate rights of the data subject excessively which including but not limited to (i) building and improving the business relationship the Company has with its users. This may include analyzing, investigating, managing and resolving issues related to the provision of the Company’s services, service satisfaction inquiry (ii) service interest analysis in order to improve the services provided by the Company to meet the needs and interests of the user (iii) protect and defend any claims the Company may have against its users throughout the relevant period as stipulated by law (iv) use of photographs and other public relations information of users participating in various marketing activities for the benefit of the Company’s public relations materials
- In the event that the service user gives consent The Company will process the user’s personal data for the specific purposes for which the user has given specific consent, such as using the information for the Company’s public relations or direct marketing purposes or of affiliated companies or forwarding and disclosing personal information of service users to affiliated companies and/or partners for marketing by affiliates or partners, etc. The user has the right to withdraw the user’s consent given to the Company at any time
The Company will collect personal information of all users as long as it is necessary, taking into account the purpose and the need for the Company to collect and process. This includes complying with the requirements of applicable law in such matters throughout the term of the relevant service contract, and for the purposes of safeguarding legitimate interests, the Company may process personal data for a period of time that is necessary for business purposes, ensuring that the user’s rights are not affected unnecessarily and in the case of processing with the consent of the user, the Company will process the data until the user withdraws their consent.
In principle, the personal information of the customers received by the Company will be kept confidential, but the Company may need to disclose and forward your personal information to
- Disclosure to the Company’s external service providers This may include (i) affiliates, partner company, third-party service providers that provide support services to the Company in providing services or performing duties and exercising rights that the Company may have towards service users such as personnel support service providers, Information Technology service provider (ii) Service providers involved in the Company’s business operations including but not limited to consulting service provider to the Company, the Company will forward and disclose personal information of the service user only within the specified objective margin on a sparing basis, under the framework of the Personal Data Processing Agreement to be drawn up
- Disclosure the customer seller’s information or the lessor to customers, buyers or tenants as the parties to the contract that will be signed between them for the purpose of ensuring the completion of the contract and the fulfillment of the functions under the contract to which it is signed; the Company will disclose such personal information only in the case that the customers who are both parties have a complete agreement and will disclose information only as necessary.
- Relevant government agencies which the Company has legal duties or subject to judgment or an order of a government agency to disclose personal information of personal service users to such agencies whereby the Company shall disclose and transmit information only as necessary in accordance with the said duties; and
- Other agencies in which the service user has given their express consent to the Company to disclose personal information of the user to such person
In the event that the Company transfers and/or sends personal data to foreign countries, the Company will set standards for entering into agreements and/or contracts with business entities, the organization to which the personal data protection and in accordance with the relevant laws to ensure that personal information will be protected safely.
The Company guarantees that appropriate security measures are in place to prevent any unauthorized or abusive access, use, change or modify disclosure of personal information that the Company receives. The Company will provide periodic reviews of such measures to ensure their suitability with industry standards and in accordance with relevant laws.
The Company respects the customer’s legal rights as data subjects in relation to your personal data that is in the Company’s control. You can request to exercise the rights you have in accordance with the conditions set forth in the law as follows: (1) Right to request for access and obtain a copy of personal data (2) Right to request correction of personal data to be correct (3) Right to request personal information in the event that the Company makes personal data in a form that can be read or commonly used by means of automated tools or equipment (4) Right to object to the processing of personal data (5) Right to request to removal or destruction or to make personal data non-personally identifiable when that information is no longer needed (6) Right to request the suspension of the use of personal data (7) Right to withdraw consent and (8) Right to complain.
