Shopping Mall Lessee Privacy Notice
JAS Asset Public Company Limited (the “Company”) intend to inform the person who may be interesting to rent and the lessee of the shopping mall spaces (the “Lessee”) of this Privacy Notice that defining the terms and conditions that the Company will be processing the Lessee’s Personal Data.
Once the Lessee agrees: (1) to provide the Lessee’s Personal Data to the Company for the preparation of the quotation; and/or (2) to accept the quotation and enter into the relevant lease agreement (the “Lease Agreement”) and give the Personal Data of the relevant Lessee to the Company, the Company shall deem that the Lessee accepts and agrees to this Privacy Notice.
In case any Lessee does not agree that the Company would be processing the Lessee’s Personal Data as defined under this Privacy Notice, the Company reserves the right to reject not to propose the quotation and/or not to enter into the Lease Agreement with such Lessee since the processing of the Personal Data of the Lessee as defined hereunder is critical and essential for the performance of any obligations that the Company may have with the Lessee.
The Company may adjust and amend this Privacy Notice from time to time to be in consistent with the relevant laws and regulations and to reflect the lease terms under the Lease. The Company will notify the Lessee of any change or amendment made through various communication channel of the Company.
The Lessee’s Personal Data that the Company would need to process include the following data:
- Direct information relating to the Lessee, including full name, address and the identification documentation;
- Contact information, including telephone number and other contact information;
- Payment information, including bank account, collateral deposit, credit card and other financial transaction evidence that the Lessee may transaction with the Company under the framework of the Lease Agreement;
- Personal Data of any other person under the control and supervision of the Lessee that the Lessee may submit and disclose to the Company for the exercise of rights to request for any supports that the Company is obliged under the Lease Agreement to provide to the Lessee under the Lease Agreement; and
- Other Personal Data that the Lessee may give consent to disclose and share with the Company for any processing purpose.
In case that the Lessee is the corporate entity, the Personal Data of the Lessee’s representative, including without limitation the representative’s full name, identification card and contact information as informed, disclosed and shared by the Lessee and once the Lessee has shared those information to the Company, the Company shall deem that the Lessee represents and warrants that the Lessee has the legitimate rights to disclose and share the Personal Data of their representative to the Company and the Lessee have already informed those persons of the Personal Data processing to be undertaken by the Company and/or obtain the obtain the relevant consent from the data subject already. Also, the Lessee agrees to indemnify and hold the Company harmless from any damages or claims that that the Company may suffer resulting from the misrepresentation by the Lessee as defined hereunder.
The Company would need to process the Lessee’s Personal Data as defined above for the following purposes:
- To (i) contact and to assess the Lessee’s qualifications and conditions in order to determine and propose the appropriate quotation as well as the right terms and conditions for the Lease Agreement; (ii) exercise any rights and perform any obligations that the Company may have with the Lessee under the Lease Agreement, including without limitation the contract management, the collection of the rental fees, the query made, the lease term extension or renewal, the provision of other supporting services and facilities as defined under the Lease Agreement and other request form; and enforce any rights and sanctions that the Company may have under the Lease Agreement and/or other instruction or guidelines that the Company may give to the Lessee (for instance in the imposition of fine or other contractual sanction under the Lease Agreement);
- To perform the legal obligations that the Company may have, including without limitation the tax and accounting obligations;
- To protect the legitimate interest and rights that the Company may have against the Lessee under the Lease Agreement throughout the lease term and after the termination of the lease agreement or the expiry of the lease term;
- In case the explicit consent is given by the Lessee, for other purposes, including to contact back to the Lessee for future lease or contact to promote any news and advertisement that the Lessee may be interesting or for other purposes that the Company will notify the Lessee from time to time.
The Company would need to process and retain the Lessee’s Personal Data for all the purposes defined above: (1) throughout the lease terms under the Lease Agreement and for the period of (i) not more than 5 years after the settlement of all the collateral deposit in case of the long-term Lease Agreement; or (ii) not more than one calendar year for the temporary booth rental; (2) for the purpose of legal obligations performance, the Company will retain the Personal Data for the period of time as prescribed under the applicable laws; and (3) in case the process is based on the consent given, the Company will process the Personal Data for those defined objective until the consent is withdrawn.
Generally, the Lessee’s Personal Data shall be kept confidential by the Company; provided that in these circumstances the Company may need to disclose and share the Lessee’s Personal Data with these following persons: (i) the third party service providers whom the Company has engaged to perform any specific service or obligations to the relevant Lessee; (ii) the third party service provider that the Company may engage in the process of protecting the legitimate interest of the Company against the Lessee, including the legal counsel or litigators; and (ii) the governmental authorities that the Company may be subject to the legal obligations to disclose the Lessee’s Personal Data to. In all circumstances, the Company commits to only disclose and share the Lessee’s Personal Data on the necessary and need-to-know basis.
The Company represents to implement the appropriate information security of the Lessee’s Personal Data to prevent unauthorized access, use, amendment or disclosure of those Personal Data and the Company commits to review the information security measures from time to time in order to ensure the compliance with the best industry practice and relevant laws.
The Company respect the Lessee’s statutory rights as the data subject under the relevant laws over the relevant Lessee’s Personal Data, including in particular the following rights: (1) the right to request for access or copy of their Personal Data as well as the right to revise or rectify the Personal Data; (2) the right to request for data portability; (3) the right to object to any process of their Personal Data; (4) the right to request for deletion or de-identification of the Lessee’s Personal Data once there is no further necessity; (5) the right to request for the suspension of the Lessee’s Personal Data processing; or (6) the right to withdraw consent. In case the Lessee would like to exercise any of these rights, please feel free to contact the Company as the defined contact channel and the Company will consider and get back to the relevant Lessee’s request within reasonable period of time after the receipt of the Lessee’s due request.
